Executor Law Demystifies the Timeline for Finalising Deceased Estates in South Africa

RANDBURG, Gauteng – South African families dealing with the loss of a loved one face a mandatory legal process to wind up the deceased’s estate, which typically takes between 12 and 24 months to complete. Governed by the Administration of Estates Act 66 of 1965, this 7-stage procedure is designed to ensure that creditors, the South African Revenue Service (SARS), and heirs are lawfully protected before any assets are distributed.

The Legal Minimums and Statutory Delays

The timeline cannot be expedited due to strict statutory waiting periods. Once an executor is appointed, the estate must be advertised to creditors for a minimum of 30 days. Later in the process, the Liquidation and Distribution Account must lie open for public inspection for 21 days. Combined with mandatory tax assessments by SARS, these legal minimums account for several months of the total timeline.

Stage 1: Reporting the Death and Letters of Executorship

The death must be reported to the Master of the High Court within 14 days. Following the submission of required documents, the Master reviews the application and issues Letters of Executorship. This initial stage typically requires four to eight weeks, depending on processing volumes at the Master’s Office.

Stage 2 and 3: Asset Collection and Creditor Advertisement

Upon receiving the Letters of Executorship, an estate bank account is opened. The executor begins consolidating investments, securing property valuations, and closing personal accounts. Concurrently, the executor is legally required to place advertisements in the Government Gazette and a local newspaper, giving creditors 30 days to submit claims against the estate.

Stage 4: SARS Tax Clearances

Securing a Tax Clearance Certificate from SARS is frequently the most time-consuming phase, taking between two and six months. The executor must submit the deceased’s final income tax returns and apply for an estate duty assessment. Complex tax histories or outstanding returns directly delay this stage.

Stage 5 and 6: The Liquidation and Distribution Account

The executor drafts a detailed Liquidation and Distribution Account detailing all assets, liabilities, and heir distributions. The account is lodged with the Master of the High Court and advertised for a mandatory 21-day public inspection period.

Stage 7: Final Distribution

Once the Master approves the account and no objections are raised during the inspection period, the executor finalizes the estate. This involves paying heirs, transferring fixed property through the Deeds Office, and formally closing the estate bank account over a two to four-week period.

While simple estates can be finalized in 8 to 12 months, delays are common. Processing backlogs at regional Master’s Offices, outstanding SARS tax returns, tracing missing beneficiaries, and resolving contested wills can extend the administrative process by months or even years.
